Scammers expand market

The Mill Creek man and nine others who are under investigation for allegedly creating fake news websites to promote their "acai berry weight loss products" were engaging in an age-old practice on the world's newest, biggest-ever medium.

Fad diets have been around forever, but the potential of the Internet to reach the largest pool of "customers" must make scammers drool like Homer Simpson coveting a donut.

While complaints about fad diets are always the same (it doesn't work), it's the websites, which are "deceptively designed to look like news reports, including sites using the domain names wwwBreakingNewsAtG.com and www.Channel9NewsReport.com" that are at the heart of the Federal Trade Commission's lawsuit to stop the advertisements.

The sites violate federal law by using the logos of major news outlets to mislead consumers into thinking they're reading real news reports, the Associated Press reported. The sites used fake endorsements from news organizations, including CNN, Fox News and USA Today.

"Almost everything about these sites is fake," said David Vladeck, director of the FTC's Bureau of Consumer Protection. "The weight loss results, the so-called investigations, the reporters, the consumer testimonials, and the attempt to portray an objective, journalistic endeavor."

It's true. But it also makes you wonder about the majority of people who say they "get their news online."

One typical lawsuit, against Tanner Garrett Vaughn of Mill Creek, says his website claims that a reporter tested an acai berry product and lost 25 pounds in four weeks without dieting or exercise. The FTC says no real reporter tested the products.

That's because real reporters don't endorse products. And real news websites don't list diets under "breaking news."

If one ignored the fake celebrity and reporter endorsements, the claim for acai berry (cited in the ad and in the lawsuit against it) is this: "The Acai Berry Products, alone or in combination with the Colon Cleanse Products, causes rapid and substantial weight loss." The FTC states the products "do not cause rapid and substantial weight loss..."

Indeed. Substitute any diet fad, from "vinegar-soaked-foods" to "grapefruit only" for "acai berry" and the conclusion is the same. The FTC received multiple complaints from people who paid from $70 to $100 for acai berry weight-loss products after "being duped by the fake news sites," AP reported. But as all the hucksters know, people who believe there is a magic weight loss food or formula (or better yet, a pill!) are duping themselves.

It's helpful to know that the phrase "without dieting or exercise" is a very plain disclaimer that the "product" doesn't work.

US cracks down on acai berry sellers

US regulators on Tuesday announced a crackdown on websites that sell acai berry weight loss products using fake endorsements from news sites such as CNN, Fox News and USA Today. 



The US Federal Trade Commission said it had asked federal courts to freeze the assets of 10 operations using "allegedly deceptive" tactics such as fake news websites to market their products.

The websites are designed to appear as if they are testimonials from legitimate newsgathering organizations.

"But in reality the sites are simply advertisements aimed at deceptively enticing consumers to buy the featured acai berry weight loss products," the FTC said.


"Almost everything about these sites is fake," David Vladeck, director of the FTC's Bureau of Consumer Protection, said in a statement.

"The weight loss results, the so-called investigations, the reporters, the consumer testimonials, and the attempt to portray an objective, journalistic endeavor," Vladeck said.

The sites often misleadingly include the names and logos of media outlets such as ABC, Fox News, CBS, CNN, USA Today, and Consumer Reports.

A photograph of photogenic French television presenter Melissa Theuriau is also frequently used to illustrate the sites although she has no affiliation with any of them.

The FTC said it has received numerous complaints from consumers who spent up to $100 for weight loss products after having been deceived by the sites.

It said it will ask the courts to force the the companies to provide refunds to consumers who purchased the supplements and other products.

The FTC said the defendants have likely received more than $10 million in ill-gotten commissions through the sites.

Weight-Loss Surgery With One Little Cut

Nicole, who is 27 and lives near Bristol, recently underwent a gastric sleeve operation to help with weight loss. Instead of the traditional procedure with multiple incisions, this one involved a single small cut.

"By the time I went home, I didn't need pain medications, so that was nice," she said. "And I was happy to have no scars on my body."

Traditional laparoscopic surgery requires multiple incisions. Inside the body, the instruments converge to create a sort of tent that gives the surgeon room to operate.

With single-incision laparoscopic surgery, the kind performed on Nicole, a half-inch cut is made in the umbilicus, or bellybutton. Surgical tools enter the body with the help of a round instrument with three holes that guide the three long instruments — one with a small camera — in the right direction. The surgeon watches a video screen to find his or her way around. Before cameras were introduced to surgery, all incisions were considerably larger.

The April 5 surgery was performed by Dr. Makram Gedeon at Bristol Hospital, where officials said it was the first single-incision gastric sleeve surgery done in the state.

Gedeon has performed single-incision surgeries before, but this was the first time he applied it to the gastric sleeve procedure, which is relatively new in the field of bariatric, or weight loss, surgery. Two more common procedures are gastric bypass and gastric banding. With a gastric bypass, staples are used to decrease the size of a patient's stomach. With gastric banding, a band is placed on the stomach, dividing it into two pouches.

The gastric sleeve procedure involves removing most of the stomach. Besides leaving less room for food, it also removes the portion of the intenstine that secretes ghrelin, a hunger-causing hormone.

That the procedure is offered at Bristol Hospital is a particular point of pride for Gedeon.

"We're happy that a community hospital like ours can provide such cutting-edge surgery," said Gedeon, who has been with Bristol Hospital for 11/2 years. "Single-incision surgery is a very exciting new field. It's going to explode in the U.S."

The most obvious advantage is cosmetic. Because the surgery involves one small cut in the bellybutton, there are no visible scars afterward. Other benefits are anecdotal. There hasn't been enough research to say so conclusively, but Gedeon said there appears to be a shorter recovery time and less post-surgery pain. The risk of infection is also potentially lower, he said.

"When you achieve all those things, that's good," Gedeon said. He performed his first single-incision laparoscopic procedure about a year ago, a gallbladder surgery. He later used single-incision surgery for appendectomies. Gedeon took a few courses to train for those procedures.

"It is difficult, and it requires appropriate surgical skill," he said. "You lose a certain amount of freedom of movement."

No formal training is offered yet for single-incision gastric sleeve surgery, but Gedeon said his previous experience with the other procedures was enough to guide him through. "The real learning curve was with the gallbladder removal," he said.

Single-incision surgery isn't appropriate for every patient; it depends on physical type. Internal organs in the patient's torso must be close enough so the instruments will reach them.

And because the procedure is new, the surgical tools available are somewhat limited.

Dr. Jim Elsey, who serves on the patient education committee of the American College of Surgeons, said the procedure is quickly becoming a common one, and he expects it won't be long before there's a greater variety of instruments for the procedure.

Elsey added that the American College of Surgeons has deemed single-incision surgery to be as safe as traditional laparoscopic surgery.

Lie face up on a mat or a level, padded surface. Bend both knees into the chest to begin. Contract your abdominals, bringing your chest, shoulders and head toward the pelvis. Reach your hands toward your feet. Maintain this contraction as you straighten your right leg up to the ceiling and your left leg in front of you. Pause for three breaths.

Keep your navel pressed toward your spine as you lower your right leg to meet your left leg. If this is too difficult, raise your left leg a few inches to make it easier to bring your legs together. Pause for three breaths. Release by bending both knees into your chest and lower your head and shoulders down to the floor. Repeat on the other side. Continue to alternate legs until you have done six repetitions on each side.

FTC goes after 'news sites' that hawk acai berry diets

The Federal Trade Commission has filed suit against 10 companies the agency says are using fake news websites to market acai berry weight-loss products.

The FTC said the defendants operate websites that seem like legitimate newsgathering sites but actually promote deceptive advertisements urging consumers to buy acai berry products.

The sites use names and logos of major media outlets such as ABC, CNN and Consumer Reports while touting articles documenting a "reporter's" own experience with acai berry supplements. The stories often claim that the reporter lost 25 pounds in four weeks.

"Almost everything about these sites is fake," said David Vladeck, director of the FTC's Bureau of Consumer Protection. "The weight-loss results, the so-called investigations, the reporters, the consumer testimonials and the attempt to portray an objective journalistic endeavor."

It is unclear how many consumers have fallen for the allegedly deceptive claims. But the FTC said the websites collectively have paid more than $10 million to advertise their fake news sites, suggesting that the site operators have earned more than that in commissions from companies that sell the products.

According to the FTC complaints, all filed in the past week, the defendants post ads on search engines and high-volume websites that drive traffic to the fake news sites. The news sites then link to other sites where merchants sell the products. The FTC said it has received numerous complaints from consumers who paid between $70 and $100 for weight-loss products after they were deceived by fake news sites.

The FTC filed five of its cases in U.S. District Court of Northern Illinois and the rest in other federal courts, asking that the defendants be barred from making deceptive claims and that the companies be required to give refunds to consumers. So far, judges in seven of the 10 cases have entered injunctions prohibiting the practices while also requiring the defendants to preserve their assets and give the FTC a full accounting of products sold and revenue collected.

The office of Illinois Attorney General Lisa Madigan also filed suit Tuesday in Cook County court against Ishmael Lopez Jr. of Sauk Village, who is accused of operating websites with fake news articles on acai berry diet products.

The attorney general alleges that when consumers click on links from Lopez's sites, including thecnnews.org, cnnewsat6.com and newsline07.com, they are transferred to other websites to sign up for free trial offers. Consumers are then automatically enrolled in a subscription for products and are not notified that they will be charged unless they cancel within 14 days, according to Madigan's office.

Efforts to reach Lopez for comment were unsuccessful. His company is not named in the FTC complaints.

Jeffrey Blumberg, a nutrition professor at Tufts University, said there is little scientific research to show that acai berries have any benefits. "They are a natural berry fruit … rich in many antioxidants, but there have been very few studies that have been performed using them," he said.

Acai berry supplements are often marketed to consumers who hope to lose weight. In 2010, the FTC filed an action that accused acai berry marketer Central Coast Nutraceuticals of deceptively marketing acai berry supplements as weight-loss products and "colon cleansers" as an aid for preventing cancer.
